These Terms of Service ("Terms") govern access to and use of sendthemsome.love (the "Service"), including the website, pages, features, and any content generation tools offered through it.

By accessing or using the Service, or by purchasing an advertisement placement, you agree to these Terms. If you do not agree, do not use the Service.

1) Operator and Contact

• "You" / "User" means any person who visits or uses the Service.
• "Advertiser" means any person who purchases or attempts to purchase an advertising placement.
• "Ad" means any banner, image, text, link, or creative submitted for display on the Service.
• "Approval" means the moment we explicitly accept an Ad for display after manual review.
• "Placement(s)" means the display locations on the Service where Ads may appear.

3) What the Service Does

sendthemsome.love is a simple app/website that:

1. Allows users to generate cute card-style content (e.g., Valentine-themed cards); and
2. Offers paid advertising banners that may be displayed for 24 hours after Approval.

No user accounts are required. There is no login system.

4) Eligibility and Age Requirements

The Service is intended for users 13 years of age or older.

• If you are under 13, you may not use the Service.
• If you are 13–17, you represent that you have permission from a parent or legal guardian to use the Service where required by local law.

5) Acceptable Use and Content Rules

You agree not to use the Service to create, submit, display, or link to content that is:

• Illegal, fraudulent, or promotes illegal activity;
• Pornographic, sexually explicit, or 18+ content (including adult services);
• Hate speech, harassment, threats, or incitement to violence;
• Misleading, deceptive, impersonating others, or likely to confuse users;
• Malware, spyware, phishing, or any attempt to collect data unlawfully;
• Infringing on intellectual property rights (copyright, trademark, etc.);
• Weapons-related promotion (including firearms, weapon accessories, ammunition);
• Medical, health, pharmaceutical, or treatment/diagnostic claims or promotions;
• Dating services, escorting, or sexually suggestive "dating"-style promotions;
• "Drastic" content (including extreme violence, gore, or shock content), as determined by us.

We may interpret and enforce these rules at our sole discretion to keep the Service safe and appropriate for a broad audience.

6) Card Generation Content (User Inputs)

When you enter text or otherwise provide inputs to generate cards:

• Do not submit sensitive personal data (e.g., government IDs, passwords, financial details, private medical info, precise location, or intimate data).
• You are responsible for your inputs and the consequences of sharing generated cards.

You grant us a limited, worldwide, non-exclusive, royalty-free license to host, display, and process your inputs and generated outputs only to operate and improve the Service (for example: rendering your card, displaying it to you, delivering a share link). This license ends when the content is no longer needed for those purposes, except where retention is required by law or legitimate operational needs.

7) Advertising: Purchase, Review, Approval, and Display

7.1 Manual Review and Approval

All Ads are subject to manual review. Submitting or purchasing an Ad does not guarantee Approval. We may approve or reject any Ad for any reason, including brand safety, user safety, legal risk, or perceived low quality.

7.2 When the 24-Hour Period Starts

An approved Ad will be displayed for 24 hours starting from the time of Approval ("Ad Display Period").

7.3 Placements

Approved Ads may appear in two possible placements:

1. At the bottom of the main section of the homepage; and
2. At the bottom section of a "valentine" card page/view.

We may adjust placements, layout, sizes, and formatting at any time for design, performance, or policy reasons.

7.4 Random Order and No Guaranteed Positioning

Ads are displayed in random order. There is no option to request a specific ordering, priority, exact time slot, or specific placement guarantee beyond being eligible to appear within the available placements during the Ad Display Period.

7.5 No Guaranteed Results

Unless explicitly stated otherwise in writing, we do not guarantee:

• A specific number of impressions, clicks, conversions, or sales;
• Any minimum traffic volume;
• Any particular demographic or geography;
• Continuous uninterrupted display (the Service may experience downtime or changes).

8) Advertiser Responsibilities and Warranties

If you purchase or submit an Ad, you represent and warrant that:

1. You own or have all necessary rights and permissions for the Ad creative (images, logos, text, trademarks) and the destination link.
2. The Ad and destination link comply with all applicable laws and regulations in every location where users might view it.
3. The Ad is not misleading and does not attempt to impersonate any person or brand.
4. The Ad does not contain malicious code, tracking methods that violate law, or phishing behavior.

You are solely responsible for your Ad content and any linked pages.

9) Removal, Suspension, and Refunds (Ads)

9.1 Our Right to Remove Ads

We may remove, suspend, or disable any Ad at any time, including during the Ad Display Period, if we believe it violates these Terms, creates legal risk, harms users, or is otherwise inappropriate.

9.2 Refund Policy for Ads

If we reject your Ad, remove it, or take it down (including after Approval), we will provide a full refund for that Ad purchase.

Refunds are processed via the original payment method through Polar (or the payment provider used). Refund timing depends on the payment processor and your bank/card issuer.

10) Fees, VAT, and Taxes

Advertising fees are displayed at purchase. You agree to pay all applicable charges.

• VAT: VAT may be charged as required by applicable tax laws.
• Tax handling & records: Payment, invoicing/receipts, and tax collection may be handled by Polar as the payment provider. You are responsible for providing accurate billing information.

11) Payments via Polar; Third-Party Terms

Payments are processed through Polar. By purchasing, you also agree to Polar's applicable terms and policies. We do not control Polar's systems and are not responsible for outages or processing delays caused by third parties.

Third-party providers such as Polar and Vercel process data under their own terms and policies.

12) Intellectual Property

The Service, including its design, branding, code, templates, and all operator-created content, is owned by the Operator or licensed to the Operator and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service unless you have our written permission.

13) Privacy and Analytics

We do not require user accounts and we do not ask users to provide personal data to use the core card-generation features. However, some data is processed automatically when you access the Service:

• Analytics (Vercel Analytics): We use Vercel Analytics to measure traffic and usage of the Service (for example: page views, general usage patterns, performance metrics). This may involve collecting limited technical information such as device/browser details, approximate location (derived from IP), and usage events.
• Security and operations logs: We may collect limited technical logs (e.g., IP address, request metadata, and timestamps) to maintain security, prevent abuse, and operate the Service.
• Payments (Polar): If you purchase an Ad, payment processing is handled by Polar, which may collect and process personal and payment information necessary to complete the transaction (e.g., billing info, payment method data, invoices/receipts). We do not store full payment card details.

14) Disclaimers

To the maximum extent permitted by law:

• The Service is provided on an "as is" and "as available" basis.
• We do not warrant that the Service will be uninterrupted, error-free, or always secure.
• We do not warrant that generated card content will be accurate, appropriate, or fit for any particular purpose.
• We are not responsible for any third-party websites linked from Ads or user-shared content.

15) Limitation of Liability

To the maximum extent permitted by law, the Operator will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, or business interruption.

Total liability cap: If you are an Advertiser, the Operator's total liability for all claims related to a specific Ad purchase is limited to the amount you paid for that Ad.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16) Indemnification

You agree to indemnify and hold harmless the Operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your Ad content or destination link;
• Your violation of these Terms;
• Your infringement of any third-party rights; or
• Your misuse of the Service.

17) Termination and Access Restriction

We may restrict or block access to the Service (including Ad submissions) at any time if we believe you are violating these Terms, creating risk, or harming users.

18) Changes to the Service or Terms

We may modify the Service or these Terms at any time. Updated Terms will be posted on the Service with a new "Last updated" date. Your continued use of the Service after changes means you accept the updated Terms.

19) Governing Law and Jurisdiction

These Terms are governed by the laws of Germany, with venue intended to be Berlin, Germany, to the extent permitted by applicable law.

If you are a consumer in the EU/EEA, you may have mandatory consumer protection rights in your country of residence that cannot be waived.

20) Consumer Information (EU)

If you are an EU consumer, you may have statutory rights, including rights related to distance selling. Where applicable, you acknowledge that advertising display is a time-limited digital service that begins upon Approval; where local law allows, you request performance to begin during any applicable withdrawal period. Nothing in these Terms limits mandatory rights you have under applicable consumer law.
